AQA Unit 4B Tort

Unit 4B on tort examines: the tort of negligence, general principles relating to physical damage and medical negligence which looks at the principles of negligence in the context of a claim for physical loss (personal injury and damage to property). It also considers the principles of negligence in the context of a claim for clinical negligence; The tort of neglgence claiming psychiatric damage and economic loss considers the principles of negligence in relation to losses other than straightforward physical damage; product liability and liability in the tort of defective goods looks at the contribution of tort law to compensating the consumer for losses caused by defective goods; Occupiers' liability examines the duty which an occupier of premises owes to both his lawful and to his unlawful visitors (tresspassers);  the tort of nuisance and the rule in Rylands v Fletcher considers the liability of those whose activities interfere with the smooth running of the lives of others. The section considers both public and private nuisance and the rule in Rylands v Fletcher and finally we look at Vicarious liability which examines the nature of an employer's liability for the torts of his employees committed during the course of employment.
